Just Climb Terms of Sale

Pro and Premium plans for climbing gyms

Version: 2026-10-25 · In force from: 25 October 2026

§1. Seller and scope

  1. The seller is 5517 Tomasz Teter, ul. Obrońców Westerplatte 6, 27-600 Sandomierz, Poland, tax ID (NIP) 8641934806, REGON 381009106, e-mail: support@justclimb.it (the “Seller”).
  2. These Terms govern the sale of paid Pro and Premium plans (a “Plan”) for climbing gyms using the Just Climb app and the justclimb.it website (the “Platform”). A Plan is a digital service provided electronically: lifted limits and access to the features described in the price list.
  3. These Terms supplement the Platform Terms. Fees on event participants’ payments are governed by the Organiser Terms.

§2. Buyer

  1. The buyer is the business running a climbing gym, on whose behalf the purchase is made by the gym’s owner or admin on the Platform (the “Buyer”). The person making the purchase declares that they are authorised to act for the Buyer.
  2. The contract is concluded between businesses. If the Buyer is a sole trader for whom the contract has no professional character (Art. 385⁵ of the Polish Civil Code), they have the consumer rights set out in §10 and protection against unfair terms.

§3. Plans and prices

  1. The scope of the Free, Pro and Premium Plans and their prices are given in the price list and on the purchase page.
  2. Prices for gyms in Poland are given in Polish złoty net, with VAT added at the applicable rate (currently 23%). The gross amount to pay is shown in the cart before payment.
  3. Prices for gyms outside Poland are given in the currency shown on the purchase page, net. If the Buyer is a VAT payer in another EU member state, the Buyer accounts for the VAT (reverse charge). Otherwise VAT is charged as required by law.
  4. A Plan can be bought for a month or a year. A yearly Plan costs the same as 10 months.

§4. Conclusion of the contract and payment

  1. Purchases are made at justclimb.pl/checkout.html after signing in with the gym owner’s or admin’s account: choose the gym, the Plan and the period, give the invoice details, accept these Terms and pay.
  2. Payments are processed by:
    • in Poland — PayU S.A., Poznań (BLIK, fast transfer, card); the payment covers one period and does not renew automatically,
    • outside Poland — Stripe Payments Europe, Ltd. (card); the purchase is a subscription that renews automatically for further periods until cancelled.
  3. The contract is concluded when the payment operator confirms the payment. The Plan starts working immediately after that confirmation. The Seller confirms the purchase by e-mail and an in-app notification.

§5. Plan period and renewal

  1. Payment through PayU: the Plan runs for the paid period. 7 and 3 days before it ends, the Seller reminds the Buyer to renew by e-mail and notification. If the Buyer renews before the end, the next period starts when the current one ends.
  2. Subscription through Stripe: the subscription renews automatically for another period of the same length and the fee is charged to the saved card. The Buyer may cancel at any time in the subscription panel (linked in the app and on the purchase page). Cancellation takes effect at the end of the paid period.
  3. If the payment for the next period fails, the Plan ends with the paid period. Stripe retries the payment for a few days and the Buyer can update the card; once a payment succeeds the Plan works again straight away.

§6. End of a Plan

  1. When the paid period ends the gym moves straight to the free Free plan.
  2. No data is deleted. The Free plan’s limits (e.g. the number of active walls or team members) apply only to adding new items.

§7. Trial

  1. After taking over a gym on the Platform, the Buyer receives 60 days of the Pro Plan free of charge.
  2. The trial requires no payment and does not turn into a paid Plan automatically. Before it ends, the Seller reminds the Buyer to choose a Plan.

§8. Events on the Premium Plan

  1. On the Premium Plan the Seller does not charge the fee described in the Organiser Terms on participants’ payments received while the Premium Plan is in force:
    • on a yearly Plan — from the first day,
    • on a monthly Plan — from the third paid month of the Premium Plan.
  2. Fees of payment operators (PayU, Stripe and other gateways) are settled by the Buyer directly with them.

§9. Invoices

  1. The Seller issues a VAT invoice after receiving the payment, to the details given at purchase, and sends it to the e-mail address provided. The Buyer agrees to receive invoices electronically.
  2. The Buyer is responsible for the correctness of the invoice details. They can be changed with the next purchase or by e-mail.

§10. Withdrawal

  1. A Buyer acting as a business has no right of withdrawal.
  2. A Buyer referred to in §2(2) may withdraw from the contract within 14 days of its conclusion without giving a reason, by sending a statement to support@justclimb.it. The Seller refunds the full amount paid within 14 days of receiving the statement, using the same payment method.

§11. Complaints

  1. Complaints about a Plan, a payment or an invoice should be sent to support@justclimb.it, with the gym’s name and a description of the problem.
  2. The Seller replies within 14 days of receiving a complaint.
  3. Complaints about the payment transaction itself may also be addressed directly to PayU or Stripe.

§12. Availability and liability

  1. The Seller makes every effort to keep the Platform running without interruption. Planned maintenance is, where possible, carried out at times of lowest traffic.
  2. Towards a Buyer acting as a business, the Seller’s liability is limited to the amount paid for the Plan in the last 12 months and does not cover lost profits. This limit does not apply to damage caused intentionally.

§13. Changes to prices and these Terms

  1. A price change does not affect periods already paid.
  2. The Seller announces a change of a Stripe subscription price by e-mail at least 30 days in advance. The Buyer may cancel the subscription before the new price takes effect.
  3. Changes to these Terms are published on this page with a new version and date. Periods already paid are governed by the version in force at the time of purchase.

§14. Final provisions

  1. Personal data is processed in accordance with the Privacy Policy.
  2. The contract is governed by Polish law. Disputes with a Buyer acting as a business are settled by the court competent for the Seller’s registered office.
  3. The Polish version of these Terms is binding.
